Private Hire Drivers Terms and Conditions

Eyecon Airport Transfers Limited is registered in England and Wales under company number 15142192. Our registered address is Suite 500, AW House, 6 - 8 Stuart Street, Luton, England, LU1 2SJ. Our Business address is Suite 9B, Aero House, 611 Sipson Road, Sipson, West Drayton, UB7 0JD. (“Eyecon Airport Transfers”, “we”, “our” or “us”).

We specialise in private hire bookings and these terms and conditions apply to your use of our driver app named ‘Cab Track’ and its services. As a driver you are introduced to clients who have booked a journey through us as a private hire operator. The other terms and conditions that will apply to your use of services include the following; (i) Our Privacy Policy and (ii) The terms of the Apple and Google Play Store.

“We, “us” or “our” Eyecon Airport Transfers.

“You” or “your” You as a private hire licensed driver and provider of the booking to clients who have booked through us as an operator.

“Service” Any of the services described in these terms including booking services provided by us and the journey provided by you.

“Fare” The amount that a client is charged for the journey.

“Legislation” The Private Hire Vehicles (London) Act 1998, The Local Government (Miscellaneous Provisions) Act 1976 and any regulations relevant to the operation of private hire vehicles.

1. Your contractual relationship with us

  • You agree that the relationship between you and us is that of client and service provider. We provide you (as client) with booking journey requests and we receive commission.
  • These terms and conditions will not render you as our employee, worker, agent or partner, and you shall not hold yourself out as such.
  • These T&C’s therefore, constitute a contract for the provision of services and not a contract of employment.
  • You as the private hire licensed driver agree and acknowledge that you have a responsibility to fulfill any and all the bookings accepted by yourself.
  • Drivers must maintain a professional and courteous behavior towards all passengers at all times.
  • Drivers must dress appropriately and ensure that their vehicles are clean and well maintained.
  • Use of abusive language or misconduct is strictly prohibited.
  • When you first register with us, you are required to acknowledge and accept our terms and conditions. In doing so, you agree to adhere to your obligations arising under these Terms and Conditions whenever providing services to clients who have booked through us as an operator.

2. Driver and Vehicle Requirements

  • Drivers must hold a valid Transport for London (TFL) Private Hire Driver’s License.
  • Hold valid proof of identity.
  • Hold a valid national insurance number.
  • Hold a valid UK driving license.
  • Vehicles must be insured for private hire use and include appropriate passenger liability coverage.
  • It is the driver’s responsibility to ensure their license, insurance, and vehicle MOT are up to date.
  • Drivers must ensure their vehicle meets TFL safety and emissions standards.
  • Vehicles must be kept clean, with no offensive odors or unsanitary conditions.
  • All vehicles must display the correct private hire signage as required by TFL.

3. Bookings

  • We at Eyecon Airport Transfers are holders of a private hire operator license issued by TFL which allows us to accept bookings for PHVs requested by clients through our website, email, telephone or online chat. We, then provide you (the driver) with booking requests to complete.
  • By saying, we will provide you with booking requests, it means that we will provide you with access to and use of our driver app named ‘Cab Track’ where you will receive the booking requests.
  • Drivers are only permitted to accept bookings through the license private hire operator.
  • Drivers must be respectful of passengers, needs and provide safe and comfortable journeys.
  • We make provision for the invitation and acceptance of bookings, and accept the booking pursuant to the legislation.
  • We are responsible for and perform all of the duties of the operator pursuant to the legislation in relation to the booking.
  • We will ensure that the private hire driver and their vehicle used for the provision of the journey are duly licensed pursuant to the legislation.

3.1 Bookings Procedure

  • Eyecon Airport Transfers will accept a booking from their client which will they will notify the client via email and text message. It will include all necessary details in regards to the journey requested.
  • We will then locate a suitable driver who can provide the journey.
  • We keep records of the booking.
  • We will also deal with any queries or complaints that a client may have or come across in regards to their booking.
  • We will also manage lost property queries.

3.2 Allocation of bookings

  • The driver will establish a contract with us for the provision of the booking journey when they select the ‘Accept’ button on the booking request via the drivers app. At the point you select the ‘Accept’ button you agree to be bound to these Terms.
  • In order for us to be able to provide you with booking requests, you will be required to; (i) enable use of location data sent from your device, so that we can check whether you are in the vicinity of the client who requires the journey. (ii) Update your status on the app, so that we are aware of your availability.

4. Fares and Payment

  • By following your acceptance of a booking you will result in charges being due to you. We charge the driver a comission of 20% on the journeys completed by you.
  • Drivers must adhere to the fare as agreed by the operator with no overcharging or unauthorized fare changes.
  • Cash payments will be collected by drivers on behalf of ‘Us’ the Operator as the driver acting as an agent for us.
  • Prior to sending the booking request to the driver, the client is provided with the fare amount which is calculated in accordance with specific programming code applied to the backend of our website.
  • No cash payments are to be accepted directly from passengers unless this is specified by the operator.
  • In respect of the PHV booking, the client becomes liable to payment to you for the journey provided. The fare charged to the client will be determined in accordance to our fare calculation method which depends on various factors including the distance between the pick-up and drop off location and the time it would take.
  • You agree and acknowledge that the comission is payable to us the operator.
  • We will provide you with a weekly statement which will set out details of the bookings you have completed during the previous week and the payment amount due to you.
  • The driver will be responsible for paying any congestion charges, car park charges which will be applicable to the journey. Our fare’s include all congestion charges and car park charges.

5. Cancellations

  • We will only mark a booking which has been accepted by yourself as cancelled if; (i) The client chooses to cancel the booking, (ii) you request to cancel the booking for any emergency reasons or incidents such as, flat tyre, accidents, breakdowns or such event where your safety may be at risk, (iii) you inform us that you have been waiting at the pick-up location for more than 45 minutes or longer.

6. Complaints

  • Drivers must co-operate fully with any investigation following a client complaint.
  • Complaints related to driver conduct, vehicle condition, or service must be reported to the operator and Transport for London

7. Term and Termination

  • We may end or suspend your contract at any time by writing to you or through telephone if; (i) you breach these terms in a way that we deem material, (ii) you fail to meet or cease to hold any or all the driver requirements.
  • The driver may end their contract at any time by writing to us or by telephone.
  • If the contract has ended then the driver must uninstall the driver app from their device.
  • If the contract has ended the driver must pay any outstanding sums owed to us.

Eyecon Airport Transfers reserve the right to amend these terms upon reasonable notice to the driver, provided that the user shall be entitled to refuse any such amendment and terminate the agreement upon the provision of written notice. It the driver does not exercise its rights to termination within four weeks after notification of such amendment, it shall be deemed to have accepted such amendment.
